UV AIR CLEANER WARRANTY
CaluTech warrants that its 2013 UV air purifiers,
the original 'Blue UV Lights' model 9002CBX,
the 'CaluTech Mini-Blue' model 9002MBX and the 'Blueray'
model ATHO60X will
be free from defect in electrical operation
from the date of shipping for the following
time periods:
Above products carry a 1 year limited warranty with an optional 10 year warranty option.
Airtronics 2006AT carries a 1 year limited warranty with an optional 2 year warranty option.
Air Quality UV Cleanser 2013AQ carries a 90 day warranty with an optional 1 year warranty option.
Ultraviolet Lamps carry a 30 day warranty as they require minimum annual replacement.
CaluTech will replace or repair, at our option,
any defective unit named above with no factory
labor or parts cost to the customer. CaluTech
does not cover transportation costs that may be incurred from sending the problem product to our facility, or any costs associated with removal
or re-installation of the unit. CaluTech does pay for all shipping costs back to you after repair or replacement.
The units have a bar-coded warranty label or
serial number. Do not remove.
This warranty is conditioned upon proper storage,
installation, use and maintenance. This warranty
is not applicable to any unit which is installed
by personnel who are not qualified to do so.
This warranty is not applicable to abnormal
stresses and operating conditions.
CaluTech shall correct any defects, at CaluTech's
option, by either repairing any defective part
or parts or by replacing any defective part
or parts or by making available new parts or
a whole new replacement unit.
The conditions of any tests concerning any
unit which is claimed to have not performed
to this warranty shall be mutually agreed upon
in writing and CaluTech shall be notified of,
and may be represented at any such tests. This
express limited warranty is extended by CaluTech
only to the original or first end-user purchaser.
Warranty claims are to be made in accordance
with CaluTech's published warranty services
program. NO IMPLIED STATUTORY WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE SHALL APPLY
BEYOND THE AFOREMENTIONED WARRANTY PERIOD. The
foregoing warranty is exclusive of all other
statutory, written, or oral warranties, and
no other warranties of any kind, statutory or
otherwise, are given or herein expressed. This
warranty sets forth CaluTech's responsibilities
regarding the CaluTech products and claimant's
exclusive remedy. Any store, reseller, associate, distributor or the like who promises any other warranty or guarantee of any kind that does not match this warranty will not honored by CaluTech Inc and any remedy should be sought from that party.
LIMITATION OF LIABILITY
CaluTech will not under any circumstances whether
as a result of breach of contract, breach of
warranty, tort, strict liability or otherwise
be liable for consequential, incidental, special
or exemplary damages including but not limited
to, loss of profits or revenues, loss of use
of the unit or any other goods or associated
equipment or damage to any associated equipment,
cost of capital, cost of substitute produces,
facilities of services, down time cost, or claims
of claimant's customers. CaluTech's liability
on any claim of any kind for any loss or damages
arising out of, resulting from, or concerning
any aspect of this agreement or from the product
or services furnished hereunder shall not exceed
the price of the specific unit or units which
gives rise to the claim.
This warranty gives the claimant specific legal
rights. The claimant may also have other rights
which vary from state to state. If any part of this warranty is found to be invalid under any State, Federal or local law that part will be struck from this warranty but the remaining warranty parts will remain in effect.
